1. About These Membership Terms
These Membership Terms set out the rules for joining, paying for, and ending a membership at Roger Gracie Academy Salford. They form part of the agreement between you and us when you sign up as a member.
Please read them carefully before you join. By signing up for a membership, you are agreeing to these terms.
These Membership Terms should be read alongside our Terms and Conditions, which cover your conduct, physical risk, and your use of our facilities. If there is any conflict between these Membership Terms and our Terms and Conditions, these Membership Terms will apply to anything related to payment and membership.
If you are under 18, a parent or guardian must read and agree to these terms on your behalf before a membership can be set up.
2. Membership Types and Pricing
We offer a range of membership options. Full details of the membership types currently available, including their names, access levels, and prices, are published on our pricing pages:
The membership type you are signing up for, and the price you are paying, will be confirmed in writing at the point of sign-up. If anything is unclear, please contact us at info@rgasalford.co.uk before you proceed.
3. Joining Fees and Registration
Some membership types require a one-off joining fee or registration fee in addition to the regular membership payment. Where this applies, it will be clearly shown on our pricing page and confirmed at the point of sign-up.
Joining fees are non-refundable unless you cancel within the cooling-off period described in Section 6.
4. How We Collect Payments
Recurring membership payments are collected by direct debit through GoCardless. You will be asked to set up a Direct Debit mandate when you join. One-off payments for items such as uniforms and merchandise are processed through Square.
We currently accept payment by direct debit for memberships and by debit card and credit card for one-off purchases. The payment methods available to you will be shown during sign-up.
Your membership payments are collected on a monthly basis. Your first payment will be taken on or around the date you sign up, and subsequent payments will be collected on the same date in each billing cycle unless a different start date has been agreed in writing.
5. Failed Payments
If a payment fails, we will attempt to collect it again. We will retry the payment after 3 days and again after 7 days.
If a payment remains outstanding after our retry attempts, we may suspend your membership until the outstanding amount is cleared. Suspension means you will not be able to attend training until your account is brought up to date.
It is your responsibility to make sure your payment details are kept up to date. If your bank details change, you must set up a new Direct Debit mandate through GoCardless or contact us at info@rgasalford.co.uk before your next payment is due.
6. Cooling-Off Period
Under the Consumer Contracts Regulations 2013, you have the right to cancel a new membership within 14 days of signing up, without giving a reason, and receive a full refund. This is your statutory cooling-off period.
However, if you attend a training session during those 14 days, you are asking us to begin providing the service before the cooling-off period ends. By doing so, you agree that you will lose the right to a full refund. If you then cancel within the 14-day window, we may charge a proportionate amount for any sessions you have already attended.
To cancel within the cooling-off period, please contact us in writing at info@rgasalford.co.uk as soon as possible.
7. Cancelling Your Membership
You can cancel your membership at any time, subject to any minimum commitment period set out in Section 8. To do so, you must give us written notice by either:
- emailing us at info@rgasalford.co.uk; or
- completing our cancellation form at https://rgasalford.co.uk/quillforms/cancellation-form.
Your cancellation notice must be given at least two full calendar months before you want your membership to end, starting from the first day of the month after the month in which you give notice. For example, if you give notice on any day in March and your notice period is two full calendar months, your membership will end on 31 May.
Your membership payments will continue to be collected during your notice period. You are entitled to continue training during this time.
Cancellations will not be accepted verbally. Written notice as described above is required in all cases.
8. Minimum Commitment Period
Some membership packages include a minimum commitment period. The length of any minimum commitment that applies to your membership will be confirmed at the point of sign-up and is shown on our pricing pages at https://rgasalford.co.uk/adults-pricing/ (adults) and https://rgasalford.co.uk/kids-pricing/ (kids). You cannot cancel during a minimum commitment period unless we have materially breached these terms.
Where no minimum commitment period is stated for your membership type, your membership is rolling and you may cancel at any time by following the process in Section 7.
Annual memberships
If you purchase an annual membership, the full amount is payable at the point of sign-up or at the start of each annual billing period. Annual memberships are non-refundable outside of the cooling-off period described in Section 6. By purchasing an annual membership, you are committing to the full 12-month term. If you wish to leave before the end of your annual term, no refund will be given for the remaining period.
9. Freezing Your Membership
You can ask to freeze your membership if you need to take a temporary break from training. You do not need to give a specific reason.
The following conditions apply to all freezes:
- You must give at least 14 days’ written notice to request a freeze. Notice should be sent to info@rgasalford.co.uk.
- Freezes take effect from the first day of the month following your notice, provided your notice is received at least 14 days before that date. For example, notice given on 17 March or earlier allows a freeze to begin on 1 April. Notice given on 20 March would mean the freeze begins on 1 May instead.
- The minimum freeze period is one full calendar month.
- The maximum freeze period for any single request is three calendar months.
- You may not freeze your membership for more than three months in total within any rolling 12-month period.
- While your membership is frozen, no regular membership payments will be collected.
- Before your freeze begins, you must pay in advance for the first billing period after your membership reactivates. For example, if you are on monthly billing, give notice in March, and your freeze runs from 1 April to 1 May, your May payment must be made before 1 April. Your regular billing cycle will then resume from 1 June onwards.
- Your membership will reactivate automatically at the end of your freeze period. The billing period covered by your advance payment will not be charged again.
- You cannot cancel your membership during a freeze period. Your cancellation notice period begins from the date your membership reactivates.
Freeze requests must be made in writing. We are not able to apply a freeze retrospectively.
10. Pro-Rata Charges
If you join partway through a billing cycle, your first payment may be a pro-rata amount covering only the remaining days in that cycle. This will be confirmed at the point of sign-up.
There is no pro-rata charge when your membership reactivates after a freeze. Your reactivation billing period is paid in advance as described in Section 9, and your regular billing then resumes from the following cycle.
11. Price Changes
We may change membership prices from time to time. We will always give you at least 30 days’ written notice of any price increase before it takes effect, and we will endeavour to give more notice than this wherever we can.
Notice of a price change will be sent to the email address we hold for you. It is your responsibility to make sure your contact details are kept up to date.
If you do not wish to continue your membership at the new price, you may cancel by following the process in Section 7. Your notice period will run from the date you give notice, not from the date the price change takes effect.
12. Your Membership Is Personal to You
Your membership is personal to you and cannot be transferred to another person. It cannot be sold, gifted, or shared. Only the named member may use the membership to attend sessions.
13. When We May End Your Membership
We reserve the right to end your membership at our discretion. Situations where we may do this include, but are not limited to, cases where you:
- behave in a way that breaches our Terms and Conditions or Code of Conduct;
- act in a way that puts other members, coaches, or staff at risk of harm;
- behave in a threatening, abusive, or discriminatory way;
- fail to bring your account up to date within a reasonable time after a payment failure;
- bring the academy into disrepute.
Where we end your membership for conduct reasons, no further payments will be taken from the date of termination. We will not refund any payments already collected for the current billing cycle.
Where we end your membership for reasons unrelated to your conduct, we will give you reasonable written notice and refund any amounts paid for a period after termination takes effect.
14. Complaints
If you have a complaint about your membership or the way a payment has been handled, please contact us in the first instance at info@rgasalford.co.uk. We will aim to respond within 5 working days.
If we cannot resolve your complaint directly, you may be able to seek further help through your local Trading Standards office or through the courts. Your statutory rights as a consumer are not affected by anything in these Membership Terms.
15. Governing Law
These Membership Terms are governed by the laws of England and Wales. Any disputes arising from them will be subject to the jurisdiction of the courts of England and Wales.
16. If Part of These Terms Is Unenforceable
If any part of these Membership Terms is found to be invalid or unenforceable by a court, the remaining sections will continue to apply in full. The rest of the terms are not affected.
